Establishment and Authority

The Office of the State Attorney General is an independent institution in accordance with Article 114 of the FGS Constitution, established by Law No. 18 issued on January 29, 1976.

Office Responsibilities

The Office is responsible for the following duties:

A
Legal Advisory

Providing legal advice on matters requested or referred from the Presidency of the Federal Republic and other government branches as stated in Article 3 of the aforementioned law, to ensure that government agency actions comply with the law. The Office provides binding legal opinions on all matters referred by the Presidency and all government members.

Government Defense

Protecting the rights and public interest of the government, defending the government and its various branches before courts in the following cases:

  • Civil Cases: Representing the government in transactions with individuals or companies such as purchases or construction projects.
  • Administrative Cases: Defending binding decisions issued by senior government officials when challenged.
  • Employment Cases: Defending government agencies in employment rights disputes.
  • Financial Cases: Handling cases related to government finances.
  • International Cases: Defending the Somali government in foreign courts.

Contracts

Preparation and review of contracts issued by the government, whether with individuals or companies.

Agreements

Preparation and review of agreements to which the government is a party before signing, whether international or domestic, and preparation of settlement agreements arising from lawsuits in consultation with the relevant agency.

Legislative Drafting

Preparation or advice on legislative drafts submitted to Parliament for approval, and answering questions from the Council of Ministers when presented for discussion and approval before submission to Parliament.

Legal Dispute Resolution

The Office works to mediate any legal disputes arising between government members, with binding advisory opinions. The Office also resolves disputes between government agencies regarding government land ownership through thorough investigation without court proceedings.

Official Gazette

Compilation and publication of the Official Gazette to inform government agencies and the public of government activities and laws issued by the government.

Legal Research

Conducting scientific research on national laws and international regulations, especially those issued by international organizations.

Training

The Office provides legal training for lawyers and other staff of government agencies.
